U.S. Senators Bill Cassidy, M.D. (R-LA) and Jim Risch (R-ID) and U.S. Representative Russ Fulcher (R-ID-01) have filed an amicus brief with the U.S. Supreme Court in support of Idaho's pro-life law, the Defense of Life Act. The brief supports the State of Idaho in defending its law against the Biden administration's attempts to challenge it.
Dr. Cassidy expressed his concerns, stating, "EMTALA has nothing to do with abortion. This law was passed under the Clinton administration—a pro-choice administration—and never mentioned abortion." He criticized the Biden administration for attempting to force hospitals to perform activities against state law.
Senator Risch highlighted the importance of Idaho's pro-life law, saying, "Idahoans have passed a strong law to protect the lives of mothers and the unborn, yet the Biden administration is seeking every opportunity to expand abortion." He emphasized that there is no federal right to an abortion and condemned the administration's manipulation of federal law.
Representative Fulcher pointed out the case's significance, stating, "The Biden administration has no authority to use EMTALA to avoid holding individuals accountable for breaking the law," emphasizing the potential harm to women and children across the country.
The amicus brief outlined various issues with the Biden administration's case against Idaho's pro-life law, asserting that the administration's actions are aimed at undermining pro-life protections not only in Idaho but also nationwide.
